Regulations


               The following regulations describe the principles of cooperation between the company "Luma-Druk" Łukasz Cyprys (business address: ul. Krasickiego 108, 97-500 Radomsko), entered into the Central Register and Information on Economic Activity of the Republic of Poland kept by the minister responsible for economic affairs (), NIP 728 244 86 36, REGON 100077703, e-mail address: info@lumagadzety.pl, and the company placing the order, hereinafter referred to as the Ordering Party.

 

I. PRODUCT VALUATION

1. Each product offered is subject to a quote by Luma-Druk each time.
2. Orders and inquiries are accepted only in writing - by e-mail.
3. Based on the information contained in the price inquiry, Luma-Druk undertakes to prepare
and return - electronically - a quote and information on product availability no later than within 3 days of receiving the inquiry.

 II. PRICES

The prices published on the website are net prices, they do not include VAT. The prices posted on the pages are only an invitation to submit inquiries within the meaning of art. 71 of the Civil Code and do not constitute an offer within the meaning of art. 66 of the Civil Code. The presented product catalog does not constitute a commercial offer within the meaning of the Civil Code, but is for informational purposes only.
Prices depend on the quantity and type of marking of given products, they do not include marking costs, preparation for marking and shipping costs.
Luma-Druk undertakes to provide the exact costs of the order in the quote.

III. ORDERS

1. After receiving a quote from Luma-Druk and making a decision to order, it is necessary to send - to the indicated e-mail address: info@lumagadzety.pl or kasia@lumagadzety.pl, an e-mail containing in the history the quote previously prepared by Luma-Druk.
2. The order should include:
- description of ordered products
- product code and name
- quantity
- type of marking, number of print colours, PANTONE numbers
- contact details of the ordering party (email, phone)
In the case of ordering products with decoration, the Ordering Party is obliged to send a graphic design in vector form in the following file formats: .eps, .ai, .cdr. with the PANTONE numbers. The marking always starts after the visualization is accepted by the Ordering Party.
3. The minimum order quantity depends on the specific product, usually it is 50 pieces. With each such valuation, Luma-Druk provides the minimum order quantity for the valued product.
4. After receiving the order, Luma-Druk confirms the availability of the ordered products, while reserving the right to refuse to process the placed order if it is physically impossible to fulfill it, e.g. in the event of a lack of assortment at the supplier or other random events.
5. After confirming the availability of the ordered products, Luma-Druk confirms to the Ordering Party that the order has been accepted for execution.
6. Confirmation of acceptance of the order for execution includes:
- order number
- detailed description of the ordered products
- price confirmation
- form of payment
- specification of the deadline
- delivery method

7. If the Ordering Party is in arrears with payments, the Contractor reserves the right not to accept another order before settling the outstanding amounts.
8. The goods purchased by the Ordering Party remain the property of the Contractor until full payment for these goods has been made.
9. Placing an order simultaneously means accepting all provisions of these regulations of cooperation between Luma-Druk and the Ordering Party.
10. In the event of cancellation of the submitted order, the Ordering Party is obliged to cover the actual costs related to the actions taken by Luma-Druk in order to complete the placed order.

                                                                              
IV.
REALIZATION

1. In the event of ordering products with decoration, the Ordering Party is obliged to send the graphic design in vector form in the following file formats: .eps, .ai, .cdr and PANTONE numbers of the design.
2. In the event of sending the design in a form other than the one provided, Luma-Druk reserves the right to charge the Ordering Party the cost of converting the submitted design to vector form.
3. In the event of preparing the design for printing, Luma-Druk reserves the right toand the right to add the cost of the graphic work performed.
4. In each case, before performing the product marking service, Luma-Druk sends the Ordering Party a visualization of the project for approval. The first two corrections are included in the price, the next ones are payable at PLN 30 net/visualization. The visualization is used for the general assessment of the graphic design of the project, the layout of the print, the correctness of the texts. There may be color deviations from the presented pattern resulting from differences in the printing technology used and differences in the substrate used.
5. After the Ordering Party accepts the visualization, the order is forwarded for execution.
6. Due to the specificity of the production process, Luma-Druk reserves the right to deliver +/- 5% of the ordered quantity of goods.
7. Due to the specificity of the production process, Luma-Druk reserves the right to shift the print by +/- 3 mm.
8. Applying prints made with decals and Art. I Magic Print techniques is a manual process. For this reason, a print position tolerance of 1-2 mm is required, which cannot constitute a basis for filing a complaint. With the direct printing technique, the print positioning is based on the top edge of the product
9. Ordered products are usually delivered in collective packaging or, for an additional fee agreed in advance with the Ordering Party, in individual packaging.
10. Print colors in the PANTONE scale are possible to obtain on a white substrate, on other substrates the colors will be close to the PANTONE scale. Permissible differences +/- 5%.
11. Luma-Druk shall not be liable for any differences between the colours and appearance of the goods in the catalogue photos and on the website and the actual colour and appearance of the goods that are the subject of the order, as well as for any minor differences in shades within the ordered goods. Despite all our efforts, we do not guarantee that the published technical data and photos do not contain any errors or omissions - which cannot be the basis for claims. In order to check the product, we recommend purchasing a sample to check the product.
12. Luma-Druk shall not be liable for any errors in the ready-to-print designs sent by the Ordering Party.

 
V. PAYMENT METHODS

1. Each order requires a 100% prepayment of the order value before the order is processed.
2. In the case of longer cooperation, it is possible to establish other forms of payment individually agreed between Luma-Druk,
and the Ordering Party.
3. Until the full payment is made, the products ordered by the Ordering Party remain the property of Luma-druk.
4. The applicable form of payment for the ordered goods is: bank transfer to the account of PEKAO SA bank account number:  
07 1240 3028 1111 0010 5000 0473 "Luma-Druk" Łukasz Cyprys ul. Krasickiego 108, 97-500 Radomsko (in the transfer title please provide the order number/proforma invoice received in the e-mail).
5. The original invoice is always sent by e-mail from the address: ksiegowosc@lumadruk.pl. If the Ordering Party requires a paper form, please let us know.


VI. DELIVERY

1. The delivery date of the ordered items agreed with Luma-Druk is only an approximate date and should not be treated as a final date.
2. Luma-Druk delivers the ordered items via shipping companies.
3. The Customer may also suggest a different method of delivering the Product (in such a case, it is recommended to contact the Printing House by sending an e-mail to info@lumagadzety.pl to agree on the details).
4. The delivery costs for orders below PLN 1,200.00 net are covered by the Ordering Party. For orders worth more than PLN 1,200.00 net, the delivery costs are covered by Luma-Druk. This rule does not apply to the shipment of mugs, their transport is priced individually.
5. Luma-Druk reserves the right to postpone the order fulfillment date or suspend the fulfillment of subsequent orders placed by the Ordering Party, in the event of unpaid payments for previous deliveries, until the dues due to Luma-Druk are settled in full.
6. Deadlines for fulfilling orders for printed items - standardly up to 14 days from the date of delivery of the goods to our warehouse and approval of the print design. In the case of large print runs or when the product is being imported, the deadlines for fulfilling the orders are determined individually.

 
VII. COMPLAINTS

1. The Ordering Party is obliged to check whether the delivered item is consistent with the order confirmation.
In the event of detecting a defect, the Buyer is obliged to send the defective goods to the address of Luma-Druk, which is shown oninvoice.
2. The claimed goods must be accompanied by a purchase document.
3. We accept quality and quantity complaints and returns of goods within 14 days from the date of delivery of the goods. Complaints are accepted for goods that are not marked or marked by our printing house.
4. If the delivered article does not comply with the order confirmation, Luma-Druk is only obliged to supplement any deficiencies, repair or replace defective goods or correct the sales invoice.
5. Luma-Druk will not accept claims for compensation for damages resulting from a delay in receiving the goods, inability to perform delivery, failure to fulfill contractual and legal obligations and the occurrence of fault when concluding the contract, unless such damages were caused by intentional activity of Luma-Druk.
6. Complaints resulting from differences in actual colors and shades in relation to the photos presented on the website will not be taken into account. Photos presented in the store are illustrative and the colors may differ slightly from the actual ones.

                                                                     
VIII. RESOLVING DISPUTES

1. In the event of a dispute between the Parties and any discrepancies or claims, the Parties undertake to cooperate in order to resolve them amicably by agreement.
2. In the absence of such agreement, disputes will be resolved by the court having jurisdiction over the registered office of Luma-Druk.

IX - CONSENT TO PERSONAL DATA PROCESSING 

Pursuant to art. 13 sec. 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (OJ EU L 119/1 of 4.5.2016), hereinafter referred to as GDPR, I declare that I consent to the disclosure, use and processing of personal data for the purposes necessary to conclude and perform the contract (Article 6 paragraph 1 letter b of the Regulation), fulfilment of legal obligations (Article 6 paragraph 1 letter c of the Regulation) (e.g. issuing and storing invoices), fulfilment of the legitimate interests of the Administrator (Article 6 paragraph 1 letter c of the Regulation) (e.g. determining, pursuing and enforcing claims).

Personal data will be stored for the period required by law, in particular for the period indicated in tax and accounting regulations, regulations on counteracting money laundering and terrorism financing.

I consent to the processing of personal data, including those regarding the telephone number and e-mail address. I share and declare that I am providing my personal data completely voluntarily.

The administrator of personal data is LUMA-DRUK, e-mail: INFO@LUMAGADZETY.PL. Personal data can be edited or deleted only by contacting the administrator.

 
ADDITIONAL NOTES


Goods that do not have a guide price are priced individually due to constant exchange rate fluctuations or a large number of possible configurations.
